iPrimus, a supplier of NBN services, has entered into a court-enforceable undertaking with the Australian Competition and Consumer Commission (ACCC) due to claims about speeds available to consumers on its fibre-to-the-node (FTTN) and fibre-to-the-building (FTTB) broadband plans.

The undertaking involves iPrimus contacting current and former affected consumers by no later than April 27, 2018, to explain the maximum speed they are able to receive and the types of remedies available.

iPrimus will provide consumers with options, including not representing that it can or will provide consumers with download and upload speeds at the maximum speeds specified in their plan, unless it can do so within four weeks of activation.

iPrimus will not represent that it can deliver speeds up to the maximum speed of a consumer's plan if the consumer's NBN connection is not capable of reaching those speeds.

The ACCC accepted this undertaking to address its concerns about iPrimus' promotion of its Speed Plans, which included statements such as "Download Speed: Up to 100Mbps. Upload speed: Up to 40 Mbps."
